Given its mission, and what it has—or has not—accomplished, what should be done with the Department of Education? Should it be maintained as is? Should it be reformed or perhaps even abolished?
On May 4, 1980, the U.S. Department of Education (DOE) opened its doors. It was a highly contentious creation—the bill establishing it barely passed the House, and President Reagan vowed to kill it—but the DOE remains. Of course, survival does not necessarily mean success. In this special three‐episode webinar marking the DOE’s 40th birthday, we’ll examine its past, present, and future. Why was the DOE, for which there is no clear constitutional warrant, established? What has it accomplished—or maybe damaged—in its four decades? What should be done with it moving forward, including, perhaps, bringing it to an end? We will discuss all of this and more as the DOE heads toward its fifth decade.

In 2001 there were only 12 private school choice programs in the country, including vouchers, tax credit scholarships, and personal tax credits and deductions. College prices were rising at “crisis” rates, and calls for “free” government pre‐kindergarten were regularly heard. During that same year, the idea to create Cato’s Center for Educational Freedom (CEF) was born, and in 2002 the CEF came to life.
In this special event, we will examine the changing state of American education over the past 20 years. What has improved? What has gotten worse? What has the CEF’s impact been? And what might the next 20 years have in store?

The 1967 Supreme Court case Loving v. Virginia ended state bans on interracial marriage in the 16 states that still had such laws. Now, 44 years after Loving, the courts are once again grappling with denial of equal marriage rights — this time to gay couples. Two California couples have filed suit against Proposition 8, the 2008 initiative that limited marriage to opposite-sex couples. The American Foundation for Equal Rights engaged David Boies and Ted Olson to lead the legal challenge. The plaintiffs in Perry v. Schwarzenegger won in federal district court, and the case is now on appeal. Plaintiffs argue that Proposition 8 violates the Equal Protection and Due Process clauses of the U.S. Constitution and impermissibly singles out gay and lesbian individuals for a disfavored legal status. The speakers on our panel believe that the principle of equality before the law transcends the left-right divide and cuts to the core of our nation's character.

The California Environmental Quality Act (CEQA) was intended to give lawmakers and communities necessary information on the environmental impact of government decisions, such as whether to approve new construction.
Over the 50 years that the law has been in effect, however, it has become a roadblock to new housing construction in California. Much of this new construction would, in fact, support California’s environmental goals by creating housing close to jobs and transit, minimizing the environmental impact of commuting. CEQA has become a roadblock to new development by opening up projects to lawsuits, often from wealthier, whiter communities that oppose the construction of dense housing.

In his final year in office, President Obama could make the world a better place simply by exercising his executive authority and ending U.S. support for the disastrous Saudi-led War in Yemen. The United States is not actively involved in the conflict, but we're supporting the campaign by providing services like midair refueling for coalition planes, intelligence and targeting support, by authorizing $8.4 billion in arms sales to the GCC, and even assisting in the naval blockade of Yemen. But in doing so, we are enabling a humanitarian disaster: over 5000 Yemenis have died since March, and over 20 million are in dire need of humanitarian assistance.
"What the President Should Do” is a new series by the Cato Institute discussing what President Obama can do using executive authority his final year in office to make the U.S. a freer and happier place.
