Tiny URL of photo of bed: http://tinyurl.com/stillreport-Houston Yesterday about 1 pm, we posted a story that was based off a Fox News story that President Obama might be able to singlehandly appoint a replacement for Supreme Court Justice Antonin Scalia because both the House and Senate are in recess for the President’s Day holiday today. Although it is true that both houses of Congress are adjourned until next week, what the Fox piece missed - and I failed to catch - was that the U.S. Constitution is very specific in regards to how long a recess appointment may endure: Article 2, Section 2 “The President shall have power to fill up all vacancies that may happen during the recess of the Senate, by granting commissions which shall expire at the end of their next session.” Supreme Court judges are appointed for life. So yes, he could appoint a temporary Supreme Court justice, however there would be several downsides to this. 1. Senator Orin Hatch said yesterday that the Senate has tools to prevent this. 2. The other 8 justices on the Supreme Court may simply reject a new temporary member; and 3. This would be seen as merely another Obama power grab and bring on reams of negative publicity raiding down on his languishing administration that would certainly spill over onto Democrats in general. Bottom line; it’s NOT going to happen, so I took the story down. Since there is now controversy over the way Judge Scalia died, the removal of the previous video had to be explained. What is the controversy? According to the Houston Chronicle in a story written by John MacCormack and updated at 2:40 pm yesterday, Feb. 14th, the resort owner, John Poindexter, knocked on Judge Scalia’s door at 8:30 am when he did not appear for breakfast. When Scalia did not answer the door, Poindexter assumed he was still asleep. Three hours later, Poindexter returned after an outing and, finding that the judge had still not appeared, entered his room: “We discovered the judge in bed, a pillow over his head. His bedclothes were unwrinkled,” said Poindexter. Poindexter said the body was cold and the judge had no pulse. He called a local doctor and concluded resuscitation would have been futile. According to the newspaper report: “He then contacted federal authorities, at first encountering a series of answering services because he was calling on a weekend.” Scalia’s death has subsequently been attributed to “natural causes”, specifically a heart attack. However, the death will forever be shrouded in mystery because who - in the midst of a heart attack - would decide: “Oh, my chest hurts. What I need is to put a pillow over my nose and mouth to restrict my ability to breath.” [insert CBS photo] It’s such a silly assumption that even the CBS News report on the death posted at 22:58 last night highlighted in red that an: “autopsy was not necessary.” Well, it certainly IS necessary to determine whether the judge died of asphyxiation or a heart attack. Until that is done by a panel of recognized forensic pathologists, murder conspiracy theories will continue to circulate – and for legitimate reasons. In addition, there are some great pictures on the Houston Chronicle site, which I will not display on this story because the photos have now been bought by Getty Images and Getty is very hard line about copyright infringement. So I will post them in my next report. The most interesting one is an actual picture of the bed and the pillows in the room taken just hours after the Judge’s body was removed to be flown home to Virginia. In the ultimate irony of ironies, within the last hour, Michelle Fields writing in – guess what – the AOL-owned Huffington Post – is reporting that the top 3 candidates said to have been interviewed by #NeverTrump-sters Bill Kristol and Mittens Romney have said thanks, but no thanks to joining in on the political suicide mission of trying to take down the Trump candidacy. According to anonymous sources Ms. Fields quotes who are close to the decision-making process, the dynamic duo has interviewed Marine General James Mattis, Ohio Governor John Kasich, former Sen. Tom Coburn, and Sen. Ben Sasse. “There were three people that we came close to convincing to jump into the race, but for very understandable personal reasons they couldn’t pivot fast enough to do it themselves and jump in.” On Saturday, Kristol tweeted that an “impressive” independent challenger with a “real chance” would be entering the race. But here comes the crucial info. The “Never Trump” movement is aware that if they fail to find a willing candidate: “… its leaders say they will accept defeat and focus their efforts on trying to reduce some of the long-lasting damage that Trump will likely have on the Republican Party.” And just what damage might that be? According to “Never Trump” supporter, Wisconsin radio host Charles Sykes: “We have to make it clear that Trumpism is not conservatism, but rather a toxic stew of nationalism and cult of personality politics.” So there you have it. The main thing Bill Kristol, Mittens Romney and company have against Donald Trump is that he supports nationalism – not their New World Order despotism. I thought the rock-solid foundation of conservatism was patriotism and nationalism? These guys are not America patriots. They do not support freedom and justice for all. They do not support governance by self-determination. They are traitors – not only to the United States – but to freedom-loving people the world over. Never let this revelation be forgotten. It’s rare that we get to peak behind the curtain of these guys’ real intentions. Nationalism is the dirtiest of dirty words to these folks. We’ll get to that story next, but first, of all, the North American Law Center has finally issued its analysis on the Cruz citizenship issue. Two weeks ago, the North American Law Center warned Ted Cruz to step out of the presidential primary race or they would be forced to release damaging information on his citizenship status. He didn’t, so late yesterday, they did. Fortunately, it is not a lengthy analysis, nor is it complex. The only two official documents that Senator Cruz has not sealed – that is hidden from public view – are: 1. His Canadian Birth Certificate Here is the actual document. This shows he in a natural born citizen of Canada, born on Dec. 22, 1970. 2. His Renunciation of Canadian Citizenship Document Here is the actual document issued by the Canadian government. [insert] Note the date: May 14, 2014 – 16 months and 2 weeks AFTER Ted Cruz was sworn in as a U.S. Senator. These two documents alone prove that Ted Cruz does not meet the requirement set down in Article II, Section 1, clause 5 of the U.S. Constitution: “No Person except a natural born Citizen … of the United States … shall be eligible to the Office of President; neither shall any Person be eligible to that Office who shall not have attained to the Age of thirty five Years, and been Fourteen Years a Resident within the United States.” It is impossible to be a “natural born Citizen” of two nations simultaneously. Cruz has presented proof positive that he was a natural born Citizen of Canada. So powerful is this simple argument, that 6 weeks ago, TNALC Chief Counsel, Stephen Pidgeon wrote to the Texas Secretary of State, Carlos H. Cascos asking: “Is it your official opinion that U.S. Senator Rafael Edward (Ted) Cruz was in fact a legal citizen of Canada in November 2012, when he ran for, was elected and certified by the Texas Secretary of State as the new U.S. Senator representing the good people of Texas, as a legal citizen of Canada?” The Cruz Campaign has asserted that Cruz was a “citizen at birth” because his mother was born in the USA and that made Ted a “dual citizen” of both the U.S. and Canada. Well, it doesn’t work that way for 2 reasons: 1. From Jan. 1, 1947 to Feb. 15, 1977, it was against the law in Canada to have “dual citizenship”. Foreign parents giving birth to a child in Canada had the option to declare the child’s citizenship. The parents of Ted Cruz chose and declared “Canadian citizenship” for Rafael Edward Cruz by virtue of the issuance of his official Canadian birth certificate, signed and sealed 30 days later on Jan. 21st, 1971 by the Director of the Health Department. 2. The term “citizen at birth” is a term used in the 14th Amendment. It states: “All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States ….” Obviously, Ted Cruz was born in Canada, and therefore subject to its jurisdiction. He has produced no naturalization papers or any other document proving that he has become a citizen of the United States. In fact, Senator Ted Cruz has repeatedly stated that he was never “naturalized” to the United States. The 14th Amendment Argument The implication of Cruz’s claim is that he is a “Native Born Citizen” of the United States. This confounds the obvious, however, as his birth certificate shows that he was a native-born Canadian. The 14th Amendment defines “Native Born Citizen” this way in its opening words: Section 1. “All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States….” How can this be any more specific? Ted Cruz admits he was born in Canada, and admits that he was never naturalized. Case closed. Cruz’s only defense has been an opinion letter in the Harvard Law Review, dated March 11, 2015. According to NACL, the letter: “… relies on the 14th Amendment naturalized-citizen-at-birth concept, despite the fact that Ted Cruz was not ‘born in or under the jurisdiction of the United States,’ was never ‘naturalized’ to the United States, and completely ignored the fact that Canada prohibited ‘dual citizenship’ in 1970, as well as the fact that ‘dual citizenship’ alone would [actually] prevent him from ‘natural born U.S.’ status.”
