A high school in Seminole County, Florida is being accused of violating students' First Amendment rights by censoring yearbook photos of students who participated in a local "Don't Say Gay" protest. Lyman high school in Seminole county, Florida has decided to censor pictures in the school's yearbook that showed students at a March, don't say gay bill protest, where students walked out of schools, they had their pride shirts. They had their pride flags, photos were taken. They were included in the yearbook and the yearbooks were printed. And now the school saying that, oh, we have to adhere to what the school board tells us has decided to censor those pictures in that yearbook, by putting giant stickers over every single one of them, right. They don't wanna spend the money to reprint the yearbook without the pictures. So they said, we'll just censor it. We a government entity, cuz it's a public school are going to censor these students exercising their first amendment rights because we just don't want people to see it. Somehow it's against the, the county's guidelines I guess. And the school says, well, we're doing it because you know, we're worried that because it happened at school, people are gonna think it was a school sponsored event and we don't want that. Okay. So all you have to do when people level that accusation at you is say it wasn't a school sponsored event there. I literally just solved your problems in five seconds, but you would rather censor these kids. So the big question is of course, does this run AF foul of our first amendment freedoms? You know, obviously the photos were of students exercising, their first amendment freedoms, a school, a government entity has now decided to censor that. So is it a first amendment violation? According to the students who put the yearbook together, it could be because this quote, this quote from one of the students actually does present it as a first amendment violation. And I don't even know the student meant to do this, but listen, this really shouldn't be happening because all we did as journalists was document what was happening at our school on our campus to have that covered up isn't right. This is censorship. Did you catch the one word, the one word in there that could easily make this a first amendment issue? I did journalists by this student referring to the yearbook staff as journalists, which makes sense because that is what they, what they are, right? The photo journalists, whatever you want to call them. It's media. And the media is protected from the government, which in this instance would be the public school interfering with their work and censoring it. That is a first amendment issue. And this student statement, We as journalists, a C L U, where you at these students need to reach out. Obviously this is not a huge, big story. It's not blowing up in the media. So I encourage them to reach out to the a C L U. This is absolutely something that that organization could handle and should handle. And I guarantee you, if they knew about it, they would handle it. So there you are. And there you have it. If these students, these yearbook staffers are in fact considered journalists, then a government entity, such as a public school, censoring, their work does run afoul of the first amendment.
