Still Report #523 - Cruz Citizenship Suit Filed
The Ted Cruz citizenship issue that became one of the hotter issues mentioned in last night’s Republican debate will now be tested in court.
An 85-year-old Houston, Texas attorney has just filed a lawsuit in U.S. District Court challenging whether Cruz is a “birthright” citizen – a term explicitly called for in the U.S. Constitution as a requirement for the President of the United States.
Newton B. Schwartz Sr. said in his 28-page complaint:
“Only the U.S. Supreme Court can finally decide, determine judicially and settle this issue now.”
Schwartz claimed no strong political connection to any particular presidential candidate, but when pressed did say that he favored Democrat Bernie Saunders in the race at this time.
Schwartz called upon the Supremes to take up the issue quickly, saying that “time is of the essence” with the Iowa caucuses and New Hampshire drawing near.
Schwartz says he has nothing against Cruz, he just wants to get the issue out of the way:
“The country will be in chaos if he’s elected president or vice president and this goes to trial then.”
Schwartz then questioned why the Senator, himself, hadn’t filed the suit much earlier just to clear the air:
“It’s such a simple procedure -- Senator Cruz should have filed it himself to avoid the question.”
“Let’s just get this thing settled before the primaries and the convention and the election.”
The case is Schwartz v. Cruz, 4:16-cv-00106, U.S. District Court, Southern District of Texas (Houston).
